Standard Conditions – June 2006

1. Specification

A final specification shall state unambiguous specifications for each element in terms of geometry, load factors, surfaces, items to be embedded, environment classifications etc, and that these are provided free of charge to us at least 1 week before our project planning commences.

2. Project

Dalton's project planning service includes in accordance with: BIPS publication
A113 model 3L:
- production drawings of each variant
- element calculations
- numbered plans
For staircase contracts, Dalton also includes:
- plan and elevation
- joint/assembly details.
Shaft elements are planned as installation in accordance with BR requirements for rubbish collection facilities.
NB: project planning is excluding any approvals needed from qualified statics.

3. Embedded items

Are included in standard execution. Only those items stated in the project briefing as standard for the element type will be included.

No loose items will be supplied apart from those specified in the tender.

6. Quality assurance

DALTON Betonelementer A/S is system certified in accordance with DS/EN ISO 9001, and holds a product certificate in accordance with DS482. Any special deliveries of concrete elements from subcontractors are product certified as a minimum to relevant standards.
Chute elements are only partially subject to certification.
Additional checks and testing are not included.

7. Price basis

Fixed price within supply period and in accordance with the Danish Enterprise and Construction Authority circular no. 174 of 10 October 1991.

8. Delivery

Elements are delivered FOC by road to the construction site in full loads.
This also applies to any separate deliveries from subcontractors.
Final cancellation of elements shall normally occur no later than 5 working days before delivery date to facilitate delivery planning.
NB: cancellation of railings shall normally be made within 10 working days before installation date to facilitate work planning.

9. Liability

Risk for elements transfer to the buyer upon the goods being off-loaded on-site.

10. Timescale

We reserve the right to allow for the influence of incoming orders on timescales from tender date to acceptance.
Should the order date change, we reserve the right to change other deadlines by at least a corresponding period.
If planned casting is delayed by such aspects as lack of details, Dalton reserves the right to demand financial compensation for lost casting time and postponement of delivery time, or that the elements are cast on the existing specification at the buyer's liability.
Delivery on our part in relation to stated delivery date shall be subject solely to sanctions in the form of daily penalties, the size of which represents 1‰ of the contract value, excl. VAT per working day.
Dalton can demand that the buyer sets up a temporary storage site in the event of delay on the buyer's part affecting delivery dates with 5 working days' notice.
Any related costs shall be borne by the buyer.

12. Defects

Should elements be defective or damaged at the time of risk transfer, written notice must be provided immediately to Dalton.
In the event of complaints from installation work or other subsequent work, Dalton can only be held financially liable providing a written agreement has been signed by Dalton prior to any repair work, waiting period or the like commences.
